My landlord is suing me
Do you need before pictures if you are suing your tenants for damage to an apartment?

It would make the matter easier to prove if you have them, but if you have an inspection report signed by the Tenant that would work too.

No, although it might strengthen the landlord's case. Any admissible evidence can be used to support a party's claim.
