Legal Question in Landlord & Tenant Law in Massachusetts
Landlord Tenet question
Our landlord has recently passed away and we received a letter from her live in boyfriend stating he has contacted a lawyer about probating her estate and in the meantime please forward all rent checks in his name. We think the whole thing seems strange anyone can say mail me the rent. See has no living realitives that we know of. What should we do we don't want to forward him the rent money especcially if the estate does not end out going to him and they where not married.

Re: Landlord Tenet question
You should not send the rent to the boyfriend. You should ask the boyfriend for copies of the documents that establish that he is the new owner and show them to a lawyer before you pay him rent. In the meantime, you should continue to pay rent as you did before. Make the checks payable to the landlord and deliver or mail them as you did before.
Re: Landlord Tenet question
I suggest the following:
If the live-in boyfriend is on the deed to the apartment you are renting, you can probably feel comfortable sending the rent to him.
If you are not able to determine the true owner of the apartment, you should send a letter to your landlord's current address indicating that you will set aside the monthly rent in a separate account, and disburse the rent due as soon as an administrator or executor is appointed by the court.
Until there is an administrator or executor of the estate of the deceased, you really can't guarantee that you are sending the rent to the correct party.
Please don't hesitate to contact my office if I can be of any assistance.
Re: Landlord Tenet question
You should send a letter to the Estate of your landlord at her last address. You should ask that the Executor or Administrator of the Estate please inform you as to where to send the rent and provide you proof of their appointment.
Inform the boyfriend that absent proof that he is the owner of the property or administrator of the Landlord's estate, that you have been instructed to deposit the rent into a separate account for the Landlord's estate.
