Legal Question in Landlord & Tenant Law in Massachusetts

My landlords mortgage was foreclosed upon and the new owner, a mortgage company, offered us $ to move out via email. They are trying to bully me, reducing their offer significantly when I asked for the first instead of end of the month. What are our rights as far as receiving notification to leave, securely receiving their financial compensation, etc?

If you have a lease they have to allow you to finish it or pay you to leave. You need an agreement with the lender.

If you are month to month, you can oppose being evicted and get more time. You can easily delay the eviction for 60 days if not more. If you have children under 7 or if you qualify as elderly or disabled you can get 6 months from the court before you vacate.

As long as you pay the rent, they cannot evict you. They should provide you with a written notice to terminate, if you are month to month. It needs to be by certified mail or by a constable or sherrif.

Until you are sure who is entitled to the rent or who has your security deposit, you should open an account and pay the money for your rent into that account.

Tell them you want a written agreement and tell them what you want in it. Money and date to leave.

Negotiate.
