Legal Question in Landlord & Tenant Law in Massachusetts

Lease Allows Pets, Condo Association Rules Doesn't

We moved into an apartment and signed a lease that states we are allowed 1 dog in the unit. After moving in one of our neighbours complained that we aren't allowed a pet under their Condo Association Rules. Now the apartment owner is saying we need to pay the Condo Assocation $200 a month or give up the dog.

Is the owner responsible for the $200 because they didn't provide us with a copy of the Condo Regulations and told us we were allowed the dog?

Based on the facts as you provided them, unless your lease requires you to pay additional fees as a result of having the dog or increases in Condo fees, it is your landlord's obligation.

Good Luck.

Based on the information you provided, the landlord did agree that you would be able to have the dog. Unless he put a clause in the lease that obligates you to pay any charges from the condo or additional charges from the condo, he is responsible for the $200.00 fee to the condo association.
