no lease tenancy

LL says we don't have a signed rental agreement, so I don't have to deposit your security deposit in a bank. Is it lawful?

your landlord is wrong as you suspect. the same law applies to all tenancies.

Landlord is full of something. Demand the return of the deposit right away.

No. The Security Deposit law applies to all tenancies where a security deposit is taken. You have a right to demand immediate return of your security deposit and should consider retaining an attorney as the landlord may be liable for treble damages and attorney's fees.
