Legal Question in Landlord & Tenant Law in Massachusetts
Long and short of it. We got a concession in our apartment when we renewed (they took off one month's rent over a year's time) we didn't make the 1st of every month deadline due to our pay dates so we have been asked to leave. I am now getting billed for the return of the concession in the amount of 663.00-does my landlord have the right to request this when my landlord broke the lease and asked us to leave (it was done through the housing court) I live in Massachusetts.

I would have to review the agreement/stipulation/concession between you and your landlord in order to have a sense of the rights of the parties. It is not clear from the facts that your landlord breached your lease agreement. If you failed to make contractual payments, then the landlord does not breach the agreement by commencing eviction. If you would like to gather your paperwork and schedule a consultation, please feel free to contact my office 617-357-4898.
