If You make a downpayment on an apartment so they can hold it and with foreseen problem you can not take the apartment again is it right for the landlord to keep your money saying that they fix the apartment for you?

That all depends on the contract terms. Did you sign something when you made the downpayment? If you did, you should carefully read through the terms of the agreement and see if there is a clause about when the landlord may keep your money and when you may be refunded. If there is no document, you should see an attorney for a more specific answer based on the details of your case.
