Can we move a former roommate's stuff to the basement?

We have asked one of our roommates to leave, and she has found another apartment. Her new lease starts Sept 1 and so does our new lease with new roommates. Our old, unwelcome roommate is no longer on the lease starting Sept 1, however, she is refusing to leave or move any of her stuff out of "her" bedroom until Sept 6. We need the room for our new roommate.

We have asked her to stay elsewhere and would like to move her belongings to the basement. Is there anything she can do to us legally if we move her things to another part of the house?

She can sue you for an illegal eviction by not allowing her to stay until September 6th. However, you can file an emergency petition for her removal based on failure to leave. Your problem is time.

The best solution is to get her to agree to stay somewhere else and let her pick-up her things on September 6th.
