i would like to move to the 1st floor being thats irs cheaper

i'm paying 750 for the 3th floor and the frist floor is empty and 100 dollars cheaper but my landlord doesn't let me move can he lawfuly do that ? not allow me and my children to move to the frist floor?

Landlord has the right to refuse to rent the lower priced apartment to you. He probably thinks that he will lose money if he lets you move to the other unit.
