Noisy Tenants Upstairs From Us

We own a condo downstairs from a condo that is rented to a tenant. This tenant is excessively noisy, well after 11 and has been spoken to several times by my fiancee and by her landlord. Unfortunately, the problem has not resolved, in fact, it has gotten worse. The landlord decided to renew her lease. What, if any, legal rights do we have to resolve this issue? We get less than 5 hrs. of sleep a night!

You should consult your condo documents to see if the Board of Trustees of the condo has any power to evict the tenant. In some condominiums, the Board is allowed to file an action against a tenant who is creating a disturbance or otherwise not complying with the condo rules/regulations. If the Board is authorized, you should petition the board and provide evidence the tenant is disrupting your quiet enjoyment.
