Legal Question in Landlord & Tenant Law in Massachusetts
Received a letter of eviction from a commercial property
We are in the process of selling our business. In January we received a letter from our Landlords agreeing to the transfer of lease to our buyer. Apparently the landlords thought the sale was final and sent a letter to vacate the premises immediatley to our buyer. What has happened is this, our lease expired on March 5th and looking over the lease it states that we needed to give written notice no sooner than 60 days but no later than 30 days prior to the end of the lease in order to exercise our option to extend the lease for another 5 years. The letter from our landlord's attorney is dated for March 5th, we received a call from our buyers attorney yesterday telling us of the situation, our buyers attorney blames our attorney and our attorney is unreachable as he is away on vacation. We don't know what to do. We can not believe that our landlord had the intention of crushing a new business like a bug, thinking that the sale was final. Everyone obviously is very distress as we all have a lot to lose, except the landlords. What recourse to we have? Any advice is appreciated. Thank you.

Buyer's attorney should negotiate a new lease with landlord's attorney.
