Legal Question in Landlord & Tenant Law in Massachusetts

Reissue of an expired 90 execution for possession

A District Court Judge in Mass,

granted a motion for a reissue of

an expired 90 day execution for

possession. Misleading and false

statements were made by the

Plaintiff's attorney in their motion.

1. Where and how can this be

appealed? Superior Court?

Appellate District Court?

2.Would one obtain a TRO? or stay

of execution?

Thank you

Re: Reissue of an expired 90 execution for possession

For what purpose? After spending hundreds or thousands of dollars on appeal, you would be right back where you are.

If the landlord wants to get you out, s/he will simply serve you with another Notice to Quit.

You may be better off finding a new place to live.
