Rent check expired

I have been living in an apartment for 6 months now and the landlord has not cashed any of my checks. I have called him many times about it, but he has done nothing. One of the checks is going to expire soon, am I legally obligated to write him a new one?

I would not re-issue any checks. However, I would segregate the funds you owe in a new account, sort of an escrow if you will. In this odd case, I might also consider stopping payment on checks more than 30 days old. Segregate the amount left, less the cost of stopping payment.

What this makes me wonder about is whether the landlord has a competency issue. No, this isn't really your responsibility, but someone who isn't cashing checks may have psychological issues. You may want to consider raising the concern, if you know of family members or close friends.
