Legal Question in Landlord & Tenant Law in Massachusetts

Am I responsible for any snow removal on the property of my apartment building? My building manager does not have the driveway plowed or the stairways/pathways shoveled when there is a snow storm and the tenants end up doing all of the work. It says nothing about snow removal in my lease.

Without reading your lease I cannot make a definitive response, but generally the Landlord is responsible for all common area maintenance including snow removal of common entry ways and driveways.

Generally, a landlord is responsible for snow removal from all areas used in common like common driveways and entry ways unless they are used exclusively by a single unit in which case the tenant of that unit may be responsible if it so states in the lease. Good Luck!

Under the state sanitary code, unless there is a written letting agreement that specifies that the tenant must remove snow and ice, the landlord must maintain all means of egress in a safe condition free of snow and ice.
