Legal Question in Landlord & Tenant Law in Massachusetts

Who's responsible ??

My tennant has a problem with

flying ants/termites in his

restaurant located near the ocean

The flying ants/termites could be

coming from under the building

where they like to nest in moist

areas......A pest control agency

has been called in to investigate.

Who is responsible to pay for the

agency to control these pests ???

Re: Who's responsible ??

It would depend on the terms of your lease and when and what is the cause of the problem. If the problem existed prior to the lease, then it would be considered the landlord's problem. If it was caused by the Tenant and his use of the building and did not exist prior to his renting the property, and depending on the terms of your lease, it may be his problem.

I would suggest you take your lease to an attorney to review. If there is no lease, then I suggest you get one sooner rather than later.
