should I return the security deposit if I evict a tenant in the middle of a tenancy year or keep it because the lease was broken

Whatever you decide to do, you want to follow the strict requirements of the Massachusetts security deposit law. A security deposit may be used to satisfy rent due and owing, damage to the unit beyond normal wear and tear. An accounting, together with any balance owed, must be tendered within 30 days of termination of the tenancy or when the tenant delivers up possession. It is always better to use an attorney.
