Legal Question in Landlord & Tenant Law in Massachusetts

A signed a lease without reading carefully

I signed for an apartment which has two bathrooms, expecting them to be fully functional. Immediately after signing though, I noticed the fine print said one of the bathroom showers does not work. Nobody mentioned it before, so I was not looking carefully at the lease. They immediately took away the lease and refused to give me a copy until the landlord signs it. The realtor promised to get the shower fixed but won't agree to put it in writing. What should I do?

You should get a housing inspection if the shower is not repaired. A landord cannot by agreement provide less than the minimum standards required in the state Sanitary Code. However, I do not know what they say about shower heads.

If there is one problem, their may be more. Hence, call your local housing inspector (usually run through your Board of Health).
