Legal Question in Landlord & Tenant Law in Massachusetts

i signed my lease one year ago with my husband and a cosigner because she said we had to because of credit and my husband had just started a new job. My lease is now up in March of 2011 and our credit is up and my husband job is great and he has been there for awhile now. Now are landlord is telling us we still need our cosigner to renew our lease and if not than we have to move out. can she do this

The landlord can set the conditions of the lease agreement.

Have you discussed your change in circumstances with your landlord?

Ask your landlord to eliminate the co-signer requirement.

Alternative would be to look for another place to rent.

Your lease will end in March, if you stay and hold over, you will become a month to month tenant until you leave or your landlord evicts you.

The short answer is yes - A landlord can require a co-signer as a term of a new lease. She does not have to renew your lease if she does not want to. That being said, she cannot forcibly remove you or your belongings without an order from the court.

The best advice I can give you is to start looking for a new place if you do not want or cannot have a co-signer on the lease as the landlord has requested.

She has the right to require a co-signor. I would ask her to re-check your credit. However, if she does not want to rent to you without a co-signor, then look for a new apartment.
