Legal Question in Landlord & Tenant Law in Massachusetts
My situation is kinda tricky and unusual. My aunt had rented out an apartment to me in her house. After paying her rent for 2 years she told me to stop paying her rent because she had surrendered her house under chapter 7 since she hasnt paid mortgage in a few years and that she wanted nothing to do with the house anymore. So she pretty much abandoned it, released her responsibilities as a landlord and walked away telling me I will recieve a bank from the letter and would have to deal with them. After some time passes me and her get into a family argument and now she sending me to court to evict me. I was a tenant at will living with my 4 year old son there. I don't want to live there anymore and I have been looking for apartments but haven't found anything yet so my question is will the judge grant me more time to stay in the meantime or do I have no chance and will get evicted at court right away? Should I get a lawyer? I know the house is in the forclosure process but its been like that forever

I'm sorry to hear that you are in this situation.
You would probably benefit greatly from speaking with an attorney. As your landlord, she has the right to evict you, but only by following lawful eviction procedures and obtaining a judgment by the Court. There are certainly things you can do to give yourself more time. Assuming the landlord starts right away, and moves as quickly as possible, you could potentially be ordered out of the apartment at the end of April or in May.
