Legal Question in Landlord & Tenant Law in Massachusetts

How to get someones junk out of your home

A friend of mine had a live in boyfriend for about 5 years. She owns the home and is the only one on the deed. He was thrown out about 9 months ago, and refuses to come and get his belongings. He has a shed out back and the whole garage full with his belongings. He sometimes goes and puts more stuff in there, and says he does not have to move anything because he says he owns everything by commonlaw marriage. How do you legally go about getting rid of his junk. Can she just throw it all away?

Yes. But first send the individual a certifed letter, RRR, advising them that if they do not make suitable mutually acceptable arrangements to remove their belongings in your presence within 30 days they will be disposed of by you thereafter. Massachusetts does not recognize "common law marriage".
