Legal Question in Landlord & Tenant Law in Massachusetts

Sued Twice for Breaking a Lease

Our corporation was sued in regards to breaking a lease. The suit was dismissed when the plaintiff/landlord did not submit all the required documents. Now a couple months has passed and we just were informed that the landlord is trying to sue us again over the same issue. Once a case has been dismissed, can the plaintiff bring the suit up again?

Re: Sued Twice for Breaking a Lease

If the first case was dismissed without prejudice for procedural flaws it may not bar another suit.

Retain an attorney as corporations must be represented by an attorney in such matters. Good Luck!

Re: Sued Twice for Breaking a Lease

if the first suit was dismissed without prejudice, they can bring it again. If it was dismissed with prejudice they cannot.

It depends on how the court's dismissal was worded.

Good Luck
