Legal Question in Landlord & Tenant Law in Massachusetts

I have a Tenant from whom I had collected a Security Deposit, I however did not deposit into a Bank Account, but did apply to unpaid rent later in the year....Will I still be liable?

There are a number of issues involved in this. When you applied the rent, did you notify the tenant that you were doing this in a statement that was signed under the pains and penalties of perjury? It is probably too late to do anythinig else in this matter.
