Legal Question in Landlord & Tenant Law in Massachusetts

Can a tenant be forced to pay for water and sewer?

I signed a lease with my landlords in 2001, and have been renting a house from them for two years now. They have been making me pay the water and sewer for the past two years. I agreed to it in my lease, but recently have been informed that massachusetts law states that that part of my lease is null and void and unenforcable by law. I need to know if this is true because there is a 600 dollar balance on the water and if not paid, they will not renew my lease may 1st. Do I by law have to continue to pay for the water and sewer? Can i recoupe any of my money that ive paid so far? Thank you

No, the landlord cannot force you to pay for water and sewer. Any agreement by you do do so is void. You may be able to sue your landlord for the money you have spent so far, and perhaps receive multiple damages.
