Legal Question in Landlord & Tenant Law in Massachusetts

Tenant/Landlord issue

My nephews signed lease for an appartment for a year. They have been there 3 wks. The landlord sold the property. The new landlord told them they have 1month to vacant the appartment. They have no money to pay an attorney. What can they do?

Re: Tenant/Landlord issue

As the others have said, the new landlord is obligated under the terms of existing lease.

If the landlord has served the tenants with a valid notice to quit, the tenants should seek the assistance of an attorney immediately. My office represents tenants in your situation, and can often work out alternative payment options (reduced fee, contingent fee, etc.).

Please don't hesitate to contact my office.

Re: Tenant/Landlord issue

First make sure they have a copy of the signed lease. Assuming they do:

Second, they should send the new owner a certified letter with a copy of the lease and inform him they expect him to honor the complete terms of the lease.

Third, they can file a complaint in housing court seeking a return of their security deposit from the original owner and seek to compell the new owner to honor the lease.

Good luck.

Re: Tenant/Landlord issue

They can take the signed lease to an attorney to request the landlord honor the terms of the contract. Good Luck!
