urgent

i have a tenant but he never make a contract with me, he was go last friday and to day he coming with the polices and the police say he can going the aparment again because no have notice quit form but he do not want sing the form what can i do? i need your help

You can still give a notice to quit even though there is no written lease contract.

Go to google.com and run the search "Massachusetts notice to quit". The first entry is for "BOSTON APARTMENTS" and says "Notice to Quit Form". It is a Massachusetts form.

Use that form to evict your tenant. Fill in the blanks. The tenant is allowed one rental payment period after they get your notice, and then they must leave. So if the tenant pays rent every 30 days, the tenant must leave the apartment 30 days (or before) after they get your notice to quit. If they pay rent every week, then they must leave one week after they get the notice. Whatever the usual rent payment time period is is the amount of time they have before they must leave after receiving the notice.

You need to give the tenant a notice to quit form. You can get one online. If the tenant is paying rent, then you give a 30 day notice and he has to get out, if he doesn't get out, then you file suit in housing court for Summary Eviction.

If he has not paid his rent, then you can also add a claim for unpaid rent.
