Legal Question in Landlord & Tenant Law in Massachusetts

verbal agreement?

went looking for an apartment with friend. landlord shows us 2 apartments. we walk into the second apt and say we'll take it. we go back and fill out the applications. we ask her what the apt number is for the apt we said we wanted and she tells us and writes it in herself. we find out later that she gave us the apt number for the 1st crappy apt she showed us and the apt we wanted is no longer available. Am i entitled to anything here or is it myfault for not taking the application and matching the number she wrote down to the number on the door.

Re: verbal agreement?

You probably don't have any recourse in this situation.

Assuming that you do not intend to take Apartment No. 1, you should make sure that you get back any last month's rent or security deposits you may have paid - as she is not entitled to them.

You have no obligation to take Apartment No. 1, and she should not force you to do so.
