Again, this is not about YOU... the court will only consider the children's best interest and your girlfriend will have to show the court that them staying with her and you is better for THEM than staying with their fathers. You are just a boyfriend... that equates to NOT family... ergo... not a parent. You don't have any rights to those children; not any more than some stranger off the street. Custody and visitation is between the parents and the children. You can be around her all that you want. The court will consider whether that is in the best interests of those children. You have to face the fact that this is an uphill battle... most people wouldn't want ANYONE with ANY Criminal record around their kids, so the courts will not consider the requests to be frivolous. Depending on what your sex offense is, the court may condition her retaining custody on whetehr or not you are in the picture... she may have to chose between the children and you.
