Legal Question in Legal Ethics in Massachusetts

Promissory Note

What are my legal rights if I loaned money to a friend and the friend does not want to repay the loan? I have a signed promissory note, however it has been two years and the person has not repaid the loan. How do I go about recouping the money?

Re: Promissory Note

I assume that you have attempted to send written notice to the debtor that you expect payment, and s/he has refused.

You will need to file a complaint in court demanding payment of the Note.

The amount due on the Note will determine the court in which you file, and if any other steps should be taken to protect your interests.
