An un-licensed lawyer has the same right to sue another person that you have. S/he may not represent another person in a court of law, but may represent him or herself.

If the attorney performed services for you while he or she had a valid license to practice law, the attorney would have a right to collect fees. If the lawyer misrepresented their licensure while they performed the services for you, they not only are barred from recovering fees; they are probably liable to you for triple damages and attorney's fees for even attempting to collect fees to which they are not entitled.
