Legal Question in Legal Malpractice in Massachusetts

Claim

I hired a lawyer to represent me in an injury matter, After about a year, I asked for my file back only to find out that he did nothing on the case. He only had my medical bills. Is this malpractice. I have two more yeras to find a lawyer or i will lose the claim.

I don't see a legal malpractice claim because I don't see how the attorney's inaction caused you damages.

I agree, in part.

You may have claims, depending if the lack of action created any problems with your case. If your attorney's actions lessened your ability to gather information and present the type of case that you could have presented if your attorney had acted promptly, then there is a problem.

At the same time, there is a responsibility on you to minimize the problem by taking action to protect the claim in the personal injury action. You cannot sit on the case and wait for the time period to act to lapse.
