Legal Question in Legal Malpractice in Massachusetts

Am I entitled to see demand?

I was involved in car accident

while I had a herniated disc

workers comp case open. Once

accident happened workers comp

case closed. The lawyer was

supposed to put the demand for

auto accident to insurance co.

He neglected to put in herni-

ated disc but said he would put

a supplemental in. He flips/

flops about putting in for this

herniated disc. Do I have the

right to see the demand and

supplemental? He speaks ''down''

to me and interrupts me any time I ask him to see the demand. I do not believe he

put the supplemental for the

herniated disc in. Is there

anything I can do? Thanks for your help.

Re: Am I entitled to see demand?

It seems that your relationship with your attorney is deteriorating. Your lawyer has, for a negligence action, 3-years to file suit. There are some exceptions. If your attorney's letter of demand to the insurer left something out, then it is ok to expect that he send a letter to the insurer and add what was omitted. It is not an issue of demands; it is an issue of a working relationship, and an explanation of why something are being done or not done. If you have any questions, contact me office.
