Legal Question in Mediation in Massachusetts

question re: petition to partition.
I and my 3 siblings are on the deed to my (deceased) Mom's property, I have been living at the home for the past 10 years taking care of property and Mom, Mom passed away in 2021. I have received 2 offers on the sale of house, both close to 1.5 mil. from real estate developers (will be a total gut rehab). Both offers were submitted to the estate attorney. My brother lives in GA and has filed petition to partition. I have not received the documentation as yet. Will this stall the process of selling?

I strongly recommend that you retain an attorney to answer and participate in the partition action. My offices routinely handles such cases. The partition action could very much slow down the process, but not necessarily. It depends on your brother's goal here. If he wishes for the house to be sold, and that is what you are in the process of doing, it is unclear why he would file a partition. Reach out to an attorney to assist you in the partition case.
