Legal Question in Medical Malpractice in Massachusetts

I want to get my deceased mothers medical records from the nursing home and hospital where she died at...there is no will and no administrator ect...now the hospital will not given them to me including the nursing home unless I am the administrator or something even tho I am her son...I need advise...

Hi Dan,

In most cases (depending, for instance, on the value of your mother's property), you could become the administrator of your mother's estate by filing basic forms in probate court, and thereby gain the legal authority to obtain your mother's records.
