Legal Question in Medical Malpractice in Massachusetts

My husband had a physical in 2005. Positive family hx. of colon/stomach cancer. Dad died at age 46. Asked MD. about screening/colonoscopy.Was told screening did not start till age 50.
2007 Dx. with stage 4 colon cancer which is inoperable. Is there any malpractice here.

Based on the information that you provided, you should look into the case further. In my experience, it is important to perform a comprehensive review of each case. In your husband's case, this would include a careful review of his medical records by an attorney and by a physician. I would want to know the answers to a wide variety of questions such as what type of colon cancer is he suffering from from, what was his symptomology that led to the diagnosis of stage IV cancer, who made the diagnosis, did he speak with any other nurses or physicians in the between 2005 and 2007, etc.. Medical malpractice cases are amoung the most difficult and costly cases to bring with success. For this reason, it is important to approach each case in a methodical manner and to understand the facts in detail before reaching any conclusions.

With a first degree relative dying of colon cancer prior to age 50, a colonoscopy, or at the very least, a fecal occult blood test should have been instituted. There is very likely a case.Please contact me directly for a complete discussion.
