Legal Question in Medical Malpractice in Massachusetts
medical malpractice
The law states three years from the time you find out. So I have a question I had surgury and it made me really sick. I went from doctor to doctor. Finally one of my doctors sent me to a new surgeon who knew right away and fixed the first surgeons mistakes. Would the statued be from the date of the first surgury or the second when I found out it was the first surgury that caused it.

Hi -
The statute "tolls" or begins at the time that you discovered, or reasonably should have discovered that medical malpractice may have occurrred. Call me if you would like to talk this one out, assuming you do not already have an attorney for your case. Thanks.
