Legal Question in Military Law in Massachusetts
Need Military Lawyer
I'am being charged with art. 92 failure to obey order. I feel very strongly that I'm being rail roaded, I have documentation to prove otherwise. They have offered NJP however I'm considering a trial by court martial. I can't trust anyone in my command or local district.
I have 18+ years of service to the military and have never been in this kind of trouble before. I need advice desperately on how to proceed. Thank you

You obviously have a lot on the line with 18+ years in the service and the taking of a stripe could mean a lot in the future for your ultimate retirement. This, however, is balanced against the fact that if you turn down the NJP and your commander prefers court-martial charges to a Special Court-Martial, while you may have a good case, you are at least running the risk of being convicted.

You may have a right to consult JAG in the TRIAL DEFENSE Office which is separate from The Staff Judge Advocate who represents the Command.
Trial Defense is ethically bound to represent your interest in attorney/client confidentially from the command. If you suspect otherwise you may ask to be referred to trial defense office of another command or to speak with the Inspector General's Office. Good Luck!
