Legal Question in Personal Injury in Massachusetts

Advice for car accident injury?

About 5 months ago, I was hit by another vehicle of whom completely admitted fault. The impact caused some very serious damage to my back and neck, which has continually left me with severe nauseating pain forcing me to cut down lots of hours from work. Traditional Rehab methods have been very painful. Recently, gentle Accupuncture has been very gradually working. My prospective attorney does not provide me with confidence or a rough forecast of what is to be done any time in the near future, and what sort of pain and suffering settlement or suit is in store for this pain that will indefinately continue. He wants to wait until the treatment is finished; the treatment may never be finished. I prefer dealing with an attorney with determination and who will give me a little bit of a game plan as to what and when something is to happen, and what is in store for me financially based on this strong case. What is your advice?.......thanks.

Re: Advice for car injury?

It is wonderful that you have found treatment that works for you. Is your acupuncturist also a medical doctor (a rare breed !)? If not, it might wise to have a physician that you trust maintain some ongoing oversight of your physical recovery.

Your lost wages are economic damages and should be compensated in full; however your pain and suffering takes more care and skill to evaluate properly. Your physical pain is certainly one factor. Others can be loss of or reduction in life's activities and recreational pursuits. It can also include any permanent loss of back or nack function. Since it takes while to determine what residual loss you have in that regard, be sure not to settle the case to fast.

These are general guidelines, But I hope they are helpful to you.

Good Luck!

Your attorney's general advice is correct. Most, if not all cases, cannot settle until treatment is finished. That being said, you should have a plan of treatment and a constant update on the case. Amount of damages is dependent on a number of issues including lost wages, pain and suffering and the policy limits imposed on the case. Kindly contact me if you need more information.
