Legal Question in Personal Injury in Massachusetts
automobile insurance question
I was rear-ended in traffic, the other driver admits fault. His ins. co. is trying to force me to take my car to a different autobody because the one I want can't do the work right away. They are threatening to stop paying for the rental car . Am I legally entitled to a number of days rental? can they force me to go to another autobody?

Re: automobile insurance question
I believe a typical policy pays something close to the number of hours of labor divided by 8. However, that isn't the natural limit of your claim. On another hand, if one body shop isn't ready and another is, the number of days difference between start dates is an expense you, by your choice of shop, cause, and the other driver's insurance company should not be liable for those days.
Sorry.
Maybe you should go ahead and use the shop they found for you; that way if the shop has to wait a few extra days for some part (or say that they do) and you rent longer, the insurance company is going to be more on the hook for the rental bill for that extension of time.
