Legal Question in Personal Injury in Massachusetts

My boyfriend & I have been together for 8+ years. The house we live in is in his name only. He has two sons & I want to know how I can make sure that if anything were to happen (God forbid) how I can make sure I keep the house.

One way to accomplish this might be to transfer the home from his name alone into both of your names jointly. This should not be done without the lender's permission.

Another way to approach this is for your boyfriend to engage in some simple estate planning. Your boyfriend can leave the home to you as part of his estate plan. He could also, for example, leave the house to you during your life, and then to his boys.

Although unrelated to the ownership of the house, another helpful planning approach may involve you petitioning for the step-parent adoption of his boys. The biological mother would need to assent, of course. In the absence of a will, this would make sure that you are appointed guardian of his boys if he were to pass away.
