Legal Question in Personal Injury in Massachusetts
car accident
I was involved in a car accident where another party had hit the car I was driving from behind in bumper to bumper traffic. Traffic had started to roll forward and suddenly the car behind me gave his car gas and slammed into us. I was driving my boyfriend's car and he is a NH resident with no insurance on his car - he was injurred and had to take the ambulance to the local hospital. The driver of the other car is clearly at fault and offered to pay and for me not to call the police. We would like to know what are our options are and will need to seek advise as to the next steps to be taken. We would like to sue the driver and we have witnesses - the car we tapped in front of us from the force of the impact from the car behind us. The accident happened in MA, the driver that hit us is from RI and the owner of the car that hit us is from RI (maybe his father's car)

Make sure you and your boyfriend get the best medical treatment for your injuries. Retain a Massachusetts attorney to file your claim and speak only with that attorney and do not accept any payments from the parties without your attorney's advice. Good Luck.

You should immediately engage a Massachusetts attorney to prepare your claim. RI has compulsory insurance, so you will probably be able to recover an award of damages.
A good lawyer can handle all of the process for you.
A rear-end collision rarely has any liability issue.

It is best to get appropriate treatment and to retain the services of an experienced lawyer who deals with these issues everyday. You may or may not have a claim for pain and suffering depending on nature of injuries and treatment. You definitely do have a claim for property damage, or rather your boyfriend does. An experienced lawyer can figure out the problems posed by out of state policies and vehicles, your knowing the answer at this instant will not help you very much. If you had a plumbing problem you would probably hire a plumber, here you probably can get a lawyer to work for a percentage of the recovery and not have to pay attorney's fees until there is a recovery.
