Car rearended, do I get depreciation
I was rearended, my SUV had 1400 miles on it, I owned it for 7 weeks there is about $6000 or so in damage and I have neck and back injuries. Am I entitled to money for the depreciation of the vehicle? I wanted a new vehicle but have been told that all the insurance has to do is repair the vehicle. I dont think this is fair. I am now stuck with a $22,000 loan for a new car which is now going to be listed as being in an accident. They cut a piece of the frame out and welded in another piece which I'm not happy with considering the car has a unibody. I also have to turn down a job with the usps because I am not able to lift at this time. I have also been without a car since Dec 22 because I don't have the money for the deposit on a rental. What can I do? I seem to be suffering because another driver ''looked away'' as he stated in the police report.

First: Cutting and welding a frame is NOT an acceptable repair to an automobile. Further, the other driver's insurance should have provided you with a rental while the repairs are being done (if your own policy does not provide it).
Second: You are entitled to compensation for your injuries, lost work and other damages to include the invovenience of medical appointments and daily pain.

Although you are not entitled to the deprecaited value of your SUV, your claim for medical expenses and pain and suffering and lost wages should more than compensate you for your trouble.
