The lawyer's compensation is due from the gross settlement. This is a standard term in contingent fee agreements.

You will need to look at the Fee Agreement that you signed. Normally, however, the attorney's fee is some percentage of the total recovery. If you need to pay certain outstanding medical bills, accounts, court filing fees, that is your responsibility.

I'm not sure if you are asking a philosophical questions or an actual one. If you are asking about your own case which is pending and you want to know if the attorney takes 1/3 before or after a medical lien is satisfied, you should ask him or her that question. I would think you have a written fee agreement and you should probably read it to see what it says. I suspect it says the gross amount recovered, which means he or she gets 1/3 of all benefits and monies recovered, whether they go to you or to repay people who already provided benefits to you.
