Legal Question in Personal Injury in Massachusetts
Confused
I was involved in an auto accident where the defendant lied about the events that trancurred, stating that I ran a traffic light. I contacted everyone I needed to contact, provided the information necessary [facts], as did the only witness to the scene who saw the accident was not my fault, I also filed legal action. After medical attention, physical therapy and all that goes with such action, I was contacted by my attorney with a settlement offer of $5000. I had never been contacted by him before nor told about this ''offer'', but now I've been told that this is the amount I'm getting for all my troubles and that it's not bad. I don't agree, but can I refuse and ask the attorney to do whatever possible for a more satisfying settlement?, even if the attorney tells me that forcing the case to court could leave me empty handed. Is this also true?

You can refuse a settlement offer. You should ask your attorney to explain in detail why he or she thinks it is a good offer. If you still don't agree, you may instruct your attorney to reject the offer. In some circumstances, going further with a case can leave you with less money or even empty-handed. Taking a case to trial usually costs several thousand dollars in depositions costs, expert fees, and so on. If the case is not likely to get a verdict that exceeds the expected costs, it often makes sense to settle early.

Yes you can pursue the case further. IF you did not notify atty, how did he know. if you did and you are dissatisfied, contact another lawyer.
