I would like to know if it is normal for a slip and fall case to be filed in a municipal civil court with a figure (monies) attached to a statement of damages sheet by an atturney without the clients knowledge. Also would like to know if anyone can point me in the right direction as to what exactly the statement of damages sheet is. I am asking this becuase I found out on my own research that my slip and fall case was filed in municiple court by my attorney without my knowledge. I though case such as these (I have extensive injuties .. ) were filed in a superior court only after a list of damages can be proven ....

In order for a case to be filed in MA Superior Court, damages have to be in excess of $25,000. The cover sheet is filled out by the attorney woithout consultation or approval from client. Attorney considers current medical bills and lost wages. Cover sheet is reviewed by court to determined if $25,000 or more is likely recovery. If not, case is bounced down to District Court
