I was crossing the street and was struck by an elderly man resulting in broken ribs and 2 knee surgerys constant knee pain and its been allmost a year and am im serious finacial trouble, what can i expect as far as settlement goes and when?

First of all, do you have an attorney? If you are trying to settle this case without an attorney the insurance company adjusters will most likely low ball you. I highly recommend that you contact a personal injury attorney to get your case moving. If you have had 2 knee surgerys that were a result of you being struck then your damage award should be the policy limits on his insurance, and possibly more if you were struck while he was working.
GET AN ATTORNEY! You have broken bones. It even meets NY's stringent requirements for suing in car accident cases. As Joseph said, the ins company will laugh tt their lowball offer. The policy limits should be paid for something this serious. I sue everybody involved and see what happens-the ins co, the driver, the title holder of the car, the resitered owner, and any employers. Your damages may exceed policy limits. These other people may not have a lot of money, and some of it may be inaccessible (e.g. SS disability) but the Court can garnish wages up to your state's percentage (e.g. 10%).
