Legal Question in Personal Injury in Massachusetts

I went to an emergency room in terrible pain. Two sonograms and blood and urine tests were done. The nurse practitioner told me that my liver enzymes were up and asked me when I had my last drink and did I do street drugs. I was upset and crying. My treatment in that ER was pretty much non existent after that. I was discharged with 10 pain pills and some sort of antacid. I went to a different ER the next day with the same pain symptoms and they found that my gall bladder needed immediate attention. It was removed the next morning. I just got home today and aside from feeling tired and slightly achy I am fine. I am really angry with the first ER and I wonder if I have a case to sue.

I've had similar cases, one involving and undiagnosed heart attack and another an undiagnosed appendix rupture. You have 3 years to sue, and once suit is filed you probably are looking at 2-3 years before a trial or settlement. Most lawyers would want to see how your condition turns out, in other words wait until you reach a medical end-point, before fully evaluating the claim for whether it is worth doing. You probably should go see a lawyer who actually does these cases, there are very few of them since it is a very difficult area. Has any doctor told you that the ER should have been able to diagnose this when you first went there? Did you present complaining of the classic symptoms and this was missed? You might get the impression this is not so easy and you would need a seriousness of purpose and commitment if you ever wanted to have this fully investigated with a view of trying to see if you have a meritorious case.
