Legal Question in Personal Injury in Massachusetts
I fell on someone's property. I fell down the stairs breaking my hip and wrist. Now, I have medical bills I can pay and no income coming in, since I am unable to work for several months. I think I fell because of a medicine that was given to me from blood pressure and the dose was too high and my blood pressure fell and I blacked out. My friends say I can still sue the people whose property I was on when I fell and their home owners' insurance will cover some of my expenses. Is that true or should I pursue suing the doctor who prescribed the medicine that made me fall.

Was there anything wrong with the stairs or handrails or lighting? If so, call me for your free no obligation consultation.

You will have difficulty bringing a claim against the doctor, although you might have a cause of action in theory it would be hard to prove. As referenced by Atty Early, you cannot just sue the homeowner unless there was something wrong with the property that caused you to fall. The fact you fell due to medication might be a reason that property defect was not responsible for your fall or injuries, but you might have caught yourself if there was a handrail. These cases are not easy. I can't understand how you have medical bills I thought it was required that everyone in Massachusetts have health insurance. In any event, the homeowner may have Med Pay coverage that could pay your bills. You would do well to consider consulting with an attorney. If you have significant injuries you may be able to get a lawyer to accept your case. Good luck. Regards, JBS
