Yes. Individuals have a right to access to the courts, with our without an attorney. When a person files suit without an attorney, that person is said to be acting "pro se." Where small amounts of money are involved, this is often resolved by filing suit pro se in small claims court. Where individuals are seriously injured and there is a substantial amount of damages involved, it is often wise to hire an attorney either on retainer or by way of a contingency fee agreement due to the complexities involved that are often beyond the expertise of individuals without legal training.
