Legal Question in Personal Injury in Massachusetts

I was hit by a man who was then arrested for DWI. My car was in the collision shop for almost two months and I had to pay for a good portion of the rental car. When I spoke to his insurance they said they would pay for the rental because he was at fault. they then claimed my car took too long to repair and would only pay for 15 days rental. I have not received any reimbursement. I want to file small claims and need to know if I should sue the guy or the insurance company.
