Injuries due to dog attack

While out walking my dog we were attached by a pit bull

that escaped from its fenced in yard through a piece of

wood that was placed against the chain link fence in an

unsecure manner. I received 8 bites to one hand and two

to the other while my 10 lb chihuahua was severely injured

and needed operations.

The owner of the pit bull is a 20 year old girl who rents

a house that her girl friend owns.

Could you tell me if I have a legal claim against the owner

of the dog or the owner of the property for damages?

There is strict liability against owner of the dog. There may be liability against the owner of the property depending upon her relationship to the dog and the fence through which it escaped. Hopefully this is helpful. If you have further questions feel free to contact me.
